At PEACE OF MIND we attach the utmost importance to the confidentiality of the personal information entrusted to us. The purpose of this notice is to provide additional detail and to explain clearly to users the data protection framework that governs this website and our services. In accordance with the applicable data protection legislation, and consistent with the principle of transparency which informs our approach, we set out below how and why we process personal information and the rights available to you.

INFORMATION WE COLLECT

In order to carry out our activities and provide services effectively, we may collect and process the following categories of information:

  • Contact details: name, surname, telephone number and email address. These may be provided via the website’s contact form, by email, telephone or through WhatsApp.
  • Information contained in an enquiry: the text of your message and any additional details you choose to provide, whether in writing, during a call or via video conference or WhatsApp.
  • Browsing data: IP address, online identifiers and related technical information, collected for security, statistical and functional purposes, as explained in this policy and our Cookie Policy.
  • Contractual and service-related data: information necessary for the management of instructions, billing, collection of fees and, where relevant, details relating to the property under management in order to perform the services requested.

It is essential that the information provided is accurate and up to date. Any changes must be notified to us so that our records remain correct.

PURPOSES AND LEGAL GROUNDS FOR PROCESSING

We process personal information for the following purposes, on the legal bases indicated:

  • To establish, perform and administer contracts for services entered into with PEACE OF MIND.
  • Legal basis: performance of a contract and, where applicable, pre-contractual steps at the request of the individual.
  • To deal with enquiries submitted via the website’s contact channels (contact form, email, telephone, WhatsApp or video conference).
  • Legal basis: the individual’s consent and, in certain cases, our legitimate interest in responding and maintaining the correspondence.
  • To send marketing communications concerning our own services. Such communications will only be sent where we have the necessary consent, or where a prior contractual relationship exists and the contact details have been lawfully obtained for the promotion of services similar to those previously contracted. Recipients may opt out at any time by following the instructions in each communication or by writing to info@peaceofmindmadrid.com.
  • Legal basis: consent or legitimate interest in the context of an existing client relationship.
  • To carry out web analytics, measurement and personalisation using cookies. Our site may deploy technical, analytical, personalisation and advertising cookies, both first-party and third-party. Non-essential cookies are installed only with your consent, which can be withdrawn at any time. Further details are set out in our Cookie Policy.
  • Legal basis: consent for non-essential cookies; legitimate interest for essential technical cookies.
  • To maintain the security of our site, prevent abuse and comply with legal obligations. This involves processing technical log data, including IP addresses.
  • Legal basis: legitimate interest in ensuring the security of information systems and compliance with regulatory obligations.

We do not take decisions based solely on automated processing that produce legal effects concerning you. Profiling is limited to analytics and advertising segmentation through cookies, carried out strictly on the basis of consent, which may be managed or withdrawn through the cookie settings panel.

RETENTION OF INFORMATION

Personal information will be retained:

  • For the duration of the contractual relationship and for as long thereafter as may be necessary to address any potential claims or liabilities.
  • Subsequently, for the statutory retention periods applicable in each case — by way of example, six years for commercial documentation and four years for tax records, without prejudice to longer periods prescribed by law.
  • In respect of marketing communications sent on the basis of consent, until you withdraw such consent or object to the processing.

After these periods, the information will be securely deleted unless there is a continuing legal obligation to retain it or an overriding legitimate interest properly documented.

ACCESS TO PERSONAL DATA

PEACE OF MIND will not transfer your data to third parties, except when required by law or regulation.

However, your data may be processed or disclosed, in accordance with the purposes described above, to the following recipients:

  • Third-party partners or providers, when necessary for the management of services provided by the Company. In all cases, PEACE OF MIND signs data processing agreements with such providers to ensure that they handle the data in accordance with PEACE OF MIND’s instructions and in full compliance with applicable data protection legislation.
  • PEACE OF MIND may also disclose the collected personal data in specific cases where such communication is required by law or demanded by competent authorities

International transfers

In cases where suppliers are located outside the European Economic Area or international data transfers are required, PEACE OF MIND will implement appropriate safeguards such as European Union standard contractual clauses, binding corporate rules or adherence to the EU-US Privacy Shield Framework, where applicable.

IP ADDRESSES

The website’s servers may automatically detect the user’s IP address and domain name.

An IP address is a number automatically assigned to a computer when it connects to the Internet. All this information is recorded in a server activity log, which allows for the subsequent processing of data to produce statistical reports about page impressions, visits to web services, access order, access points, etc.

SECURITY MEASURES

PEACE OF MIND will take all necessary steps to ensure your personal data are protected, preventing their loss, alteration, or unauthorized access. We regularly review our systems to detect potential security issues.

However, as a user, it is important for you to understand that internet security is not infallible, and it cannot be guaranteed that your personal data will not be accessed, disclosed, altered, or destroyed in case of a breach of our security measures.

YOUR RIGHTS

Under the General Data Protection Regulation, you have the following rights in relation to your personal information, free of charge:

  • To obtain access to the information we hold about you.
  • To require rectification of inaccurate or incomplete information.
  • To request erasure of your information where it is no longer required for the purposes for which it was collected, or in other circumstances provided by law.
  • To request restriction of processing in circumstances established by law (for example, where the accuracy of the data is contested, where processing is unlawful and you oppose erasure, where we no longer need the data but you require them for legal claims, or pending verification of overriding legitimate grounds following an objection).
  • To object to certain processing on grounds relating to your particular situation.
  • Not to be subject to decisions based solely on automated processing.
  • To request the portability of your information in a structured, commonly used and machine-readable format, for transmission to another controller where legally permissible.
  • To withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

To exercise these rights, please write, enclosing proof of identity, to Calle Müller 43, 4ºB, 28039 Madrid, or email info@peaceofmindmadrid.com. If you do not receive a satisfactory response, you are entitled to lodge a complaint with the Spanish Data Protection Agency (Agencia Española de Protección de Datos), the supervisory authority for data protection matters, at: C/ Jorge Juan, 6, 28001 Madrid (www.aepd.es).
